So it is legally his son's find, the father only has a half claim if he owns the land it was found on. I am surprised the neighbour hasn't tried to make a claim too as it was on the fence line.

Fair point kev.... and as you say a wonderful find, 3 foot is a deep hole for a garden fence post....
