If you own your own home you cannot detect in your garden (privately owned land) but if you live in a council house (publicly owned land) you should be OK to detect you own garden.

UPDATE 07-11-2020
We received a response from the DCMS yesterday on our challenge for the guidance they issued on the 5th November; sadly they indicated they are not changing the lockdown guidance for our hobby.
The NCMD is however continuing to challenge these guidelines to ensure that common sense to applied to our hobby. We will not give up without a fight. A letter was sent yesterday to the Minister, Oliver Dowden MBE, Secretary of State for Digital, Culture, Media and Sport and copied to our Prime Minister, Boris Johnson, putting forward our case.
We would like to have better news for you. Hopefully the Minister will move swiftly to shift the DCMS’s position on how the legislation is interpreted for our hobby. We will keep you informed.
Whilst we are as upset and angry as many of your are by the guidelines, for our hobbies reputation and to avoid you receiving heavy fines, we would still urge you to follow them and not detect on private land at this time.

So, I spoke to a friend who is a QC about the guidance and the law.
He said,in a far more eloquent way than I.........
The purpose of the law is to prevent individual households mixing either indoors or out. That can be a house, garden or in this case a field.
The guidance reflects that. The field, unless you own it, is the landowners garden and you, the detectorist, aren`t allowed in.
The law allows you to exercise in public spaces and the guidance permits the hobby, with the usual permission, in public places.
Simple when you think about it.

So why does it relate to metal detecting and not other activities such as fishing on private land. ? It looks like the PAS are responsible for instigating our predicament. Lets hope we can reciprocate the gesture at a later stage.

Public spaces over eons of time are on a landowners property.
Why cant we detect with the landowners permission on those public spaces.
What makes them any different than a city councils public spaces
